 This Privacy Policy applies to the collection, use, disclosure and handling of personal information by the DefSys Connect Pty Ltd (ABN 39 156 550 202) and its associated entities (collectively DefSys, we or us), including during your use or receipt (as applicable) of our goods and services and your use of our website at (Website). 

DefSys respects your privacy and protects the personal information we hold about you. We committed to complying with the Australian Privacy Principles set out in the Privacy Act 1988 (Commonwealth) (Act) and our privacy policy outlines how we manage your personal information. 

What information we collect from you

We primarily collect personal information that is necessary for us to provide our goods and services to you and to provide you with information about other goods and services we offer that may be relevant to you. 

Personal information that we collect from you may include (but may not be limited to) your name, contact details, Internet Protocol (IP) address, interests, job title and other personal information you may disclose to us when you contact us with a query or complaint, or where you request a product or service from us, or information which is contained in any other communications between you and us. Where relevant we may ask you for other information, for example, qualifications and employment history, if you apply for employment with us. 

The purposes for which we collect your information may include:

(b) contacting you (including via electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner);

(g) billing purposes 

How we collect your information

(a) provide personal information to us; 
(b) browse or use our Website (including via cookies). Much of this information will not be personal as it will not reveal your personal identity; 
(c) contact and correspond with us, for example to ask for information. 

We may also collect personal information about you from another DefSys entity, from publicly available sources, or in some cases, from third parties including SquareUp, YotPo, Stripe.. 

We only collect personal information that is necessary for us to provide our goods and services to you and to provide you with information about other goods or services we offer that may be relevant to you. If you provide us with your email address, you agree that we may send you email communications of our newsletters or updates. 

If we are not able to collect personal information about you, we may not be able to provide you with goods; services and assistance to the extent that they require us to collect, use or disclose personal information. 

How we use the Information

DefSys may use or disclose your personal information for the purpose for which it was collected. We may also use and disclose your personal information for a secondary purpose that is related to a purpose for which we collected it, where you would reasonably expect us to use or disclose your personal information for that secondary purpose. 

Other instances when we may use and disclose your personal information include where: 

(a) you have expressly or impliedly consented to the use or disclosure; 
(b) we use or disclose the information in confidence, to our advisers and insurers; 
(c) we use or disclose the information to third parties to improve our services and obtain feedback; and
(d) where the use or disclosure is authorised or required by, or under an Australian law or court/tribunal order. 

We may also disclose your personal information to third parties, including: 

(a) our advisors and consultants; and 
(b) third party service providers we use in conducting our business, including, without limitation for example, POS systems, Loyalty partners, billing platforms, Cloud services. 

Some of the third parties to whom we disclose your personal information may be located outside Australia. The countries in which these third parties are located will depend on the circumstances. However, in the course of our ordinary business operations we commonly disclose personal information to third parties located in the following countries: Australia, US, India, and UK. 

We require that these organisations to protect your information in the same way we do. We will never sell your personal information. 

Information about the Website, goods and services

We may contact you via email, SMS or other means in order to provide you with updated information about the goods or services you have purchased from us, the Website, in relation to DefSys news or 

to provide you with other information about our goods or services. If you do not wish to receive any such information, please contact us as set out below. 

We will hold your personal information for only as long as is required to fulfil the purposes for which it was collected or as required by law. 

Storage and security of your information

DefSys will take reasonable steps to keep any personal information we hold about you secure. We use a range of physical and electronic procedures to ensure the privacy of your personal information is safeguarded. These include physical access to our offices, a secure database system, and firewalls. The internet is not secure however and we cannot guarantee the security of any information sent to us via the internet. 

However, except to the extent liability cannot be excluded due to the operation of statute, we exclude all liability (including in negligence) for the consequences of any unauthorised access, modification or disclosure to your personal information. Please notify us immediately if you become aware of any breach of the security of your personal information. 

Third party sites

The Website may contain links to and from the websites of third parties (Third Party Sites). If you follow a link to any of these Third Party Sites, please note that they may be governed by their separate, respective privacy policies and that we do not accept any responsibility or liability for the use of any personal information or other data by third parties. 

How you can access your Information

You have a right to request access to or correction of your personal information held by us. If you wish to access, correct or update any personal information we may hold about you, please contact us as set out below. However, we may charge for providing access to this information and we may refuse access where the Act allows us to do so. We will use reasonable endeavours to respond to all requests for access to personal information within 30 days. 

Complaints process

If you have any questions or concerns about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or the Act, please contact us as set out below. When contacting us, please provide as much detail as possible in relation to the query, issue or complaint. 

Your complaint will be taken seriously and will be assessed by an appropriate person with the aim of resolving any issue in a timely and efficient manner. We request that you cooperate with us during this process and provide us with relevant information we may require.
